Cobb County's evolution stickers face court challenge Monday

ATLANTA - Science textbooks in Cobb County warn students that evolution is "a theory, not a fact." The controversial disclaimer faces a federal court challenge Monday from a parent who argues the stickers promote the teaching of creationism.

Cobb school officials will defend their 2002 decision to place the stickers in textbooks, which they say simply encourages students to keep an open mind. The trial, in U.S. District Court in Atlanta, is expected to last four days.

The stickers read, "This textbook contains material on evolution. Evolution is a theory, not a fact, regarding the origin of living things. This material should be approached with an open mind, studied carefully and critically considered."

They didn't go over well with at least six parents, who filed a lawsuit with the Georgia chapter of the American Civil Liberties Union.

"I'm a strong advocate for the separation of church and state," one of the parents, Jeffrey Selman, told the Marietta Daily Journal. "I have no problem with anybody's religious beliefs. I just want an adequate educational system."

In his lawsuit, Selman and the ACLU argue that evolution has been singled out for religious reasons. Gravity, they point out, is also a theory, but there's no sticker about that in science books.

The Cobb school board adopted the stickers because three science texts they adopted in 2002 were criticized by some parents for presenting evolution as fact. More than 2,000 people signed a petition opposing the biology texts because they did not discuss alternative theories, including creationism.

Seven months later, Cobb school officials approved a policy allowing "broad-based curriculum" in schools, including creationism. The decision brought national media attention to the county.

Evolution has long been a hot topic for Georgia schools. Earlier this year, Georgia Secretary of Education Kathy Cox said a new state science curriculum would drop the word "evolution" and replace it with "changes over time." Cox and state school officials quickly changed their minds after a storm of criticism from science teachers and national media.

A lawyer for Cobb County schools, Linwood Gunn, said he expects the evolution stickers will hold up in court.

He said the stickers "improve the curriculum while also promoting an attitude of tolerance for those that have different religious beliefs."

I wonder if this guy is aware that evolution violates his "separation of church and state" in that evolution is a faith based belief under the guise of "science"?

In all my life and learning I can say without hesitation that "evolution" has had no educational benefit whatsoever.

Court Hears Evolution Dispute
School District Lawyer Believes Approach Will Withstand Legal Challenge

ATLANTA -- A warning sticker in a Cobb County science textbook that says evolution is "a theory, not a fact" was challenged in court Monday as an unlawful promotion of religion.

Cobb County schools put the disclaimers in three biology texts two years ago, after more than 2,000 parents complained the books presented evolution as fact without mentioning rival ideas about the origin of life.


A group of parents and the American Civil Liberties Union filed a lawsuit over the stickers. "It's like saying everything that follows this sticker isn't true," said Jeffrey Selman, a parent who filed the lawsuit.

In the trial's opening statements Monday, ACLU lawyer Maggie Garrett argued the stickers are an endorsement of religion because only evolution is mentioned. Other scientific theories, such as cell theory, don't get similar treatment, she said.

"The religious views of some that contradict science cannot dictate curriculum," Garrett said.

The sticker reads, "This textbook contains material on evolution. Evolution is a theory, not a fact, regarding the origin of living things. This material should be approached with an open mind, studied carefully and critically considered."

A lawyer for the school district, Linwood Gunn, said it was silly to consider the stickers a promotion for religion.

"It doesn't say anything about faith. It doesn't say anything about religion," he said.

Gunn said the sticker was meant to "encourage critical thinking" and said it didn't imply that evolution was wrong. He held up a table of contents from one of the high-school biology texts and listed all the chapters on evolution.

"The sticker doesn't exist independently of the 101 pages about evolution," Gunn said.

U.S. District Judge Clarence Cooper asked Gunn why it is necessary to have a sticker clarify evolution as a theory.

"You said the text says that it's not a fact, it's a theory," Cooper said. "Why put a sticker on the book when that's already in the book?"

Gunn replied that school board members were simply trying to accommodate all views.

The first witness, parent Marjorie Rogers, started the drive to put the stickers in the books. She said it was only fair to put a small disclaimer in a textbook where religious-based ideas about the origin of life aren't mentioned.

"I don't want the Bible taught in the classroom. But there is a wealth of science that would support intelligent design, and that is not taught," she said. "There should be a marketplace of ideas."

Later, when asked her own opinion about evolution, Rogers said, "I'm a six-day, literal Bible creationist myself. But I'm not saying that should be taught in school because that's my religion, that's my faith."

The judge also heard from a North Cobb High School science teacher who said some students point to the sticker and argue evolution is "just a theory." The teacher, Wes McCoy, said the sticker was put there because some school board members didn't want evolution taught.

The sticker "diminishes the status of evolution among all other theories," McCoy said.

"I was worried. I didn't want college admission counselors thinking less of their science educations, thinking they hadn't been taught evolution or something," he said.

The trial, which will be decided by Judge Copper, is expected to last several days. The list of witnesses includes college science professors, school board members and other parents.

Testimony Ends In Evolution Sticker Trial

ATLANTA -- Testimony concluded Wednesday in the lawsuit against Cobb County Georgia schools for placing disclaimer stickers about evolution in high school biology texts.


Closing arguments will be made Friday morning.

Federal Judge Clarence Cooper will then decide whether the disclaimers pasted on the inside covers of high school biology texts in 2002 violated the separation of church and state.

Parents demanding removal of the stickers claimed that by singling out evolution as "a theory, not a fact," the school system is injecting religion into science classes.

But Cobb County school officials said the stickers are meant to promote tolerance and have increased classroom discussion of evolution without injecting religion into the schools.

The real issue here is that the atheist-pagan religion feels threatened by the stickers. They have had such a stronghold in the public schools for so long that they got comfortable. I have a news flash for them. Their "comfort zone" is about to change. America is sick and tired of the propaganda pushed by the evolution religionists. Yes evolution is a religion. It takes far more faith to believe man came from a rock which is exactly what evo origins teaches. So the real problem with the few that have wasted our tax dollars taking this issue to Federal court, is that THEIR RELIGION is under the gun and they are losing their stronghold.
